  • Driving School Franchise

    Good evening all

    As I’m new to this forum, apologies in advance if this has already been answered, but here goes….

    I signed up for a PDI Training and subsequent Franchise earlier this year. However, due to lack of pupils, I have looked at transferring the sponsorship and training to a different company.
    My problem is that the current company want me to pay £6500 to buy out my 6 month trainee franchise.
    As there’s no mention of this in the original agreement, can I return the car and terminate my franchise without having to pay this fee?

    We have had one or two cases involving cancellation of driving school franchises. From memory the contracts in those cases had clauses dealing with cancellation and liability for early termination. Are you sure your contract says nothing about this?

    It is likely to be a Business to Business contract so not covered by the law on unfair contract terms in consumer contracts.

      Sorry, but the various contract documents relating to this franchise need to be examined in detail.

        As a start does the driving school post its standard franchisee contract form/T&C on its website? Some do. If so post a link to it on here.

          Thanks for your replies

          I am aware that previous questions have been asking about consumer credit acts and similar.

          My question is in regards to specific clause or clauses that state financial obligations are to be met in lieu of 6 months notice whereby I transfer my PDI Licence Sponsorship and subsequent additional 20 hours training as required by DVSA, are shown.

          Unfortunately I am unable to upload a copy of the agreement at this precise moment

            Please come back when you can provide the clause. Some kind of financial obligation in lieu of contractual notice is to be expected.
