    Hi
    I have stopped paying my monthly amount to cabot as they cannot produce a signed CCA. I have informed them that I have stopped paying. They have continued to send me texts and letters requesting payment. I have written a complaint to them regarding this and they replied saying that although the debt was legally unenforceable they were still going to continue to pursue via a debt collector calling at my home to help reengage with them. I have received an email form RESOVE informing me that someone will be calling at my home. Please can someone advise me where I stand re this

    Print out the following, put it in an envelope, keep by door, hand it to Resolve if they actually visit.

    Dear Sirs,

    Your ref: Account No: XXXXXXXX

    Please be advised that I will only communicate with you in writing. I have noted your repeated attempts to contact me over the past few weeks and these have been duly logged by time and date. Should it be your intention to arrange a doorstep visit, please be advised that under FCA rules, you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

    There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.). Therefore take note that I revoke license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

      Thank you for your response. I decided to send the letter you advised to print out and hand to them if they came to the house, in the hope that this would prevent them coming to my home. However this morning Resolve came to my home. It took me by surprise and I had not printed out the letter in readiness for a possible visit. I did not open my door to them I could see the resolve identity card around the chaps neck. I told him I did not want to talk. He put a card through my door stating time and date they had called and phone number to get in contact with Resolve. He then sat outside my house for about 20 minutes. Same colour car was outside my house again this afternoon for approx 20 minutes but it was half parked in front of a tree and I could not be sure if it was Resove or just coincidene it was the same colour and I did not go out to investigate. My questions are

      Is there a strong possibility they will come again ? (and I have now printed out the above letter to hand to the)

      Where do I stand re them sitting outside my house?

      If they do come again how long can this harassment continue ?

      Can Resolve take a debt that is unenforceable ?

        Try not to worry.

        a) Is there a strong possibility they will come again ? (and I have now printed out the above letter to hand to the)

        They might, but they'll go away when they've wasted enough of their own time. Good that you've got it printed, ready to hand.

        b) Where do I stand re them sitting outside my house?

        That's 'harassment', that's like 'intimidation'.

        c) If they do come again how long can this harassment continue ?

        They shouldn't be 'harassing' you period.

        d) Can Resolve take a debt that is unenforceable ?

        If it's 'unenforceable', they can chase it (they can't park outside of your house for 20 minutes), but can't take it through the Courts.

        Amend and send the following to Resolve, make sure you get Proof of Postage.

        Explain exactly what happened here, he parked the car outside of your house for 20 minutes etc. You felt harassed and intimidated, the experience has left me distressed.
        I am protected from harassment under the Protection from Harassment Act 1997. If further harassment takes place, I will report the matter to the police, Trading Standards and the Financial Conduct Authority.

        There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd [1959] 2 QB 384. per Lord Evershed M.R.).           We appreciate someof our customers may not wish to provide such persoanl information by email and ask that you contact us ...........

          I really dont understand why they have responded to the above letter I sent the in this way. Any thoughts on way forward responding or not responding to this

          And should I send a letter to Cabot who are the instigating company re Resolve
