  • Defamation

I have always found this site a sensible starting point , i recently attended a conference in which it has been alleged i made homophobic remarks , i have since obtained statements from the two "independent witnesses " i have also had a face to face meeting with the Employer beyond that i would rather not expand but i am confident having been labelled with such a description , which is not true , i wish to pursue a case for defamtion . I appreciate substantial costs on the back of this circa £15k upwards , however no win no fee would by preffered route , the objective is to clear my name and let this very large organisation be made aware they cant just act as "judge and jury " at no time have they ever confronted me both at the event or even at our meeting they just presented a spcific action , i want to challenge them cause the certain individual who has caused me sleepless nights and also threaten press invlovement - so its a case of finding a practise that will look at the facts and consider taking on the case, however the issue is a major financial services company , so the odds are always stacked against the individual ie the claimant

OK, so you know about the huge cost, and costs risk, of defamation action.

Are you aware that a statement is not defamatory unless its publication has caused, or is likely to cause, serious harm to your reputation? (s1 Defamation Act 2013) This is a hurdle that you will need to clear; many claims fail this test.

I am not clear whether you are asking our opinion on whether you have a credible Defamation claim, or if you are asking us to help you find NWNF solicitor who would take the case on. Please can you clarify.
All opinions expressed are based on my personal experience. I am not a lawyer and do not hold any legal qualifications.

Thank you for the prompt reply my thoughts are if you take on a major financial institution little prospect of a win without huge costs being borne out and risks , my objective is at the very least to pursue a case if not at least get a stern solicitors letter detailing my case and cause some concern for the individual concerned of course if codsts attached that action then fine they will be met , in a professional circle people cannot go about making acquisitions with no substance, in respect of the "alleged incident " i have two witness statements that had been provided to the third party who has stated i made homophobic comments and as resulted in our business agreement being terminated without any evidence and without asking for my input, so that is unacceptable , i also want to reserve the right to approach the fininacial press , so its more about not just the case but at least can we express our view that this is unaccep[table , i prefer a lwayer to do that more chance of them sitting up and taking notice if a cost so be it , happy to meet reasonable costs

Termination of a business agreement may amount to serious harm.

And please use full stops to create shorter sentences!

[QUOTE=atticus;n1704546]Termination of a business agreement may amount to serious harm.

I agree the company have terminated a business agreement of twenty years standing, they have noted stated a reason deliberatley, however through the email correspondence its perfectly obvious why those steps had been taken. So the question i ask is their a solicitor practise you can recommend that i can contact to discuss this further.
