update - we’ve been given a court date. However they have informed me they will not be attending and have asked the court to decide in their absence and have submitted a witness statement.

So you weren't able to come to an agreement at mediation?

Have you received anything from the court?
I would have expected you to have received court directions regarding filing a witness statement, which you will need to write

Hi,

No could not come to an agreement at mediation. They have sent en email and witness statement saying they will not be attending court and they would like it to be heard in their absence.
do you want to see the witness statement?
