    Hi guys,

    Hope you're all well.

    Last year I received a parking charge notice from a firm called Uk Car Park Management Ltd. I think I did a bit of research on the firm, possibly on this forum or on the net and the general consensus was that you would not get anywhere replying to these guys.

    Bit of a background on the Parking notice.

    The driver of the vehicle was parked outside my garage for a very short period of time at a block of flats whilst obtaining the keys to the garage from my flat. Whilst being parked there a parking charge notice was issued - the initial notice did not have anything regarding how long the car had been parked. I initally spoke to the management company of the block and they were adamant that they would not revoke the charge.

    I have since received the odd letter threatening legal proceedings from the various companies linked to UK Car Park Management Ltd - Debt recovery plus & Gladstones.

    I have now received a claim form from the Claimant UK Car Park Management Ltd with their solicitors Gladstones. I understand I need to acknowledge the claim, I have read threads in the past which mention to follow the response pack which is written and posted - my first question is, am I ok to acknowledge this online? My second question is, am I intending to contest jurisdiction?

    Why do you think the court might not have authority to hear the case?

    You should also send a CPR31.14 request to Gladstones and a SAR to UK Car Park Management
    Templates for both requests are in the SHORTCUTS panel on the right of this page.

    If you want help with your defence please post up copy of claim form (redacted) and car park signs.
    What does your lease say about parking ?

    Obviously do not identify the driver on here or when communicating with claimant's team.

      Sorry I misunderstood the contesting jurisdiction question.

      Can I send these reqeusts via email or do they have to be via post?

      I have posted up the copy of the claim form and the signs. It is a little strange as there are no permits required for this site so technically people who do not reside at the block are free to park in the parking spaces without any penalty...

      Also dont know if this helps but the address they have put in the particulars of the claim is slightly incorrect - it mentions an area which is not where the site actually is.

      The lease does not say anything about parking as this is a fairly new operation they have only been operating on the site for around a year or two.

        Send those requests by email asap.
        We need to see a copy of the original parking notice as attached to vehicle (if possible) and certainly a copy of the Notice to Keeper which would have been sent by post.

        If you have disposed of these documents you should get a copy in response to your requests.

        Come back to this thread when the documents are to hand, or a week before your defence is due (whichever is the sooner!)

          Ok no probs will send those over today. Sorry to be a bit silly on this but given that I sent off my acknowledgement today when does the defence have to be submitted by? Is it usually 28 days and what happens if I do not receive any documentation from them by then?

          Also based on the particulars the only thing I can request on the CPR form is the contract right?

            In the CPR you ask for all the documents they rely on, especially any mentioned in the PoC i.e.terms of parking, signage,(contract), PCN.
            You could also request a copy (redacted) of the contract between the parking company and the land occupier.

            If your lease does not mention anything about parking, does it include anything about the garage?
            How long have you lived there?
            Did the management warn you about changes about the parking facilities?

            You have 33days from date of issue of claim in which to send defence (28 days + postal time) but best not to leave it to last minute!.
            If you don't receive the documents no need to panic as your defence will take care of their failure.

              Hi,

              So the meeting between owners happened in August 2022 a couple months before I bought my property in the block. The management company then issued a notice on the portal in Jan 2023 which seems like it was a message from the parking company just confirming signs had been put up and enforcement would begin on said date. They confirm in this message that there would be no permits sent out just enforcing parking in front of garages.

              Also I must add - I dont recall receiving the initial PCN notice via post I only have a reminder letter that was sent to me. I did not get a PCN in the window. The reminder letter I have mentions an issue time and a date. However there is nothing about the duration etc. I suspect the pictures of the vehicle were taken by a resident and passed on to the parking company.

                      Ok I’ve since received a response from other firm. There is a lot of information here. Is there any specifics I need to post or shall I post everything. Just to be clear addresses and personal details need to be taken redacted but timings and dates can stay in?

                          Hi,

                          Please see attached documents sent over from UK Car Park Management Ltd.

                          They have also sent along the images that they took which are in the letters. Would you like me to add them?

                          Also the two documents that Gladstones have sent me are basically the two parking charge notices that UK car park management ltd have sent me today.

                          The contract they refer to is the parking notice that is displayed on site which I have previously uploaded.
