  • pcn and county court claim

    hi, ive just had a letter from county court about a pcn I had no clue about. yes the car in question is registered to me but I have defiantly never been to this place. and another pcn from dcdl claiming the sum of £340 for going in a private carpark which I have also never been. I want to give a defence but not sure how to go about it. and also I had a letter from Lowell about a phone contract I used to have from 02 saying I owe £59 and have also put it on my credit file, I have no issue paying them if im in the wrong which im not sure I am because im sure I payed my last payment but I would also like it to be removed of my file if possible. thank you in advance for any advice. sincerely

    Regarding the county Court claim for the parking incident:
    1. follow the directions on the response pack and acknowledge the claim.
    Do not enter a defence at this point.
    2 Send a subject access request to the parking company
    3. Send a CPR31.14 (template in SHORTCUTS panel on the right of this page) to DCB Legal
    4. Post up a photo of the Particulars of Claim (remove identifying details first)
    5 what other PCNs have you received?

    Regarding the claim from Lowells, to avoid confusion please start a new thread about it and supply the following details:
    Received a claim? Yes/No:
    Issue Date:
    Have you Acknowledged the Claim?:
    Total Amount Claimed : ( approximately please do NOT use EXACT figure given on the claim form, round up to next £100 or £1000)
    Claimant’s Name:
    Solicitors Firm:

    Original Debt (eg. Credit card/Loan/Overdraft) :
    Particulars of Claim: ( Please type out in full excluding names/account numbers/exact amounts ):

      When asking if you have received any other PCN'S. I believe DES8 is trying to find out if your car has been cloned, Hopefully the parking company can provide photographic evidence and you can check if it is actually your car. The other question is, Does anyone else have access to your car and are they able to drive it.

          Ok, that is DCBL's standard template.

          Response to tesla6518 could be useful

          Acknowledge claim and send off those requests.
          When you get a response post up on this thread, or a week before your defence is due in (35 days from date of issue of claim)
