  • 6 year limit CCJ - Can they still enforce?

    Hi there!

    Just a quick one! I had a debt from Lowell for 3k that I received a CCJ for. The judgement was dated December 2018. I made a couple of payments around 2021 but nothing since. Is the debt no longer legally enforcible as it's over 6 years since the judgement?

    I didn't know if making a payment reset the 6 years? I only ask as they sent a couple of letters before Christmas threatening enforcement action.

    After 6 years the ccj is removed from the register whether a debtor has made payments or not. The debt still exists though and the creditor has to obtain court permission to enforce the debt

      Under what circumstances would they obtain permission to enforce the debt? Wouldn't they need extenuating circumstances as to why they have not enforced the CCJ?

        Yes they would need a good reason such as debtor moved, or emigrated temporarily, and the creditor has only just found the debtor's latest address

          Thanks for the quick reply. So considering the above doesn't apply, would I be safe to assume I can ignore their threats of legal enforcement action?
