  • Money left in trust to children

    Hi there
    wondering if anyone would be able to help please.
    my children have been left some money by their grandmother that has passed. The wording of the will states the following:
    the sum of ……. to my Trustees to invest the same in any investments hereinafter authorised with power from time to time to vary such investments and to hold the said sum and the investments representing the same and the income therefrom In Trust for my …….
    If she shall survive me and attain the age of 21 years absolutely.

    it then goes on to say


    if any of the aforesaid beneficiaries shall be under the age of 18 years at my death my Trustees may pay his or her legacy to his or her parent or guardian whose receipt shall be a full and complete discharge to my
    Trustees.

    does this mean that if as the parent I would like to set the trust up and manage it myself for my child that the executors have to abide by this this?

    The executors are also the Trustees

      Also much better to transfer the inheritance straight into a children's trust, thereby missing out the parents entirely. If paid to the parents first and then on to the children the tax authorities may deem this a gift from parent to children, giving rise to totally unnecessary tax implications for both .

        You should consider opening a childrens savings account and possibly a junior ISA for your child| (maximum investment £9k p.a.) and asking the executor trustee to pay money straight into that account

        Relatives who can't think what to buy the child for a present may ask if the child has a savings account they can pay money into
