  • Boundary ditch issue

    We currently have a dispute with our neighbours involving a hedge and ditch boundary between properties, our title excludes the hedge and ditch so the neighbours have full ownership of both. It appears they wish to erect a fence on our side of the ditch which we believe would require it to be located on our land.

    After the exchange of many letters and ignoring our requests to have a joint survey, they have now placed stakes and tape along the edge of the ditch claiming they are within their boundary, however we believe they are located on our side of the boundary. We have asked them to either remove the stakes or provide ​​​evidence to confirm the position of them, however they have not done so and are now advising if we remove them they will regard it as deliberate and knowing trepass.

    Any advice on this matter? For instance what repercussions could we expect if we do remove them ?
