  • Adhering to contract when other people have been fulfilling the duties

I have been working for a college as a site supervisor/manager for nearly 4 years and live on site.
My contract is in two parts: employment contract and occupancy agreement and the people who agreed on the terms of both contracts (previous headmaster and my previous line manager) do not work here anymore. Only they and myself know what I agreed to do and they have always supported me.

New headmaster wants me to adhere to certain terms set out in occupancy agreement that I was never asked to do. College have been paying 5 different people to cover mentioned duties.
Now I am being threatened that if I do not adhere to those terms he will terminate my contract.

    Can he legally do that?

Do you have a copy of both the employment contract and occupany agreement you were given by the previous headmaster / line manager?

Yes, I do have both contracts. Shall I send them over to admin email?

That is not necessary, I was just wanting to know you had the documents available that you signed up to.

Is the occupancy agreement a contractual part of your employment contract or is it non contractual and subject to being changed with notice?

          Hello,
I am afraid I do not know the answer to your question. Theyvare two separate documents. There is 4 weeks notice on the occupancy agreement.
My understanding is that even though there are two separate documents when I accepted the post/job the ocupancy agreement become part of my contract (I could have taken the job without taking the house and could have negotiated better pay but I opted for the house) so until now I believed that those two cannot be separated (maening that as long as i work here I am entitled to stay in the house, unless for whatever reason I will decide to move out myself or my employment contract is terminated which would also ).

If the occupation agreement is separate and not a contractual part of your employment contract then your employer may well be entitled to change the terms of the occupancy agreement.

Again you need to check the occupancy agreement about any provisions to make changes to it.

I do however suspect that things I would expect to be in agreements of this nature regarding the provision of making changes may not be set out.

Have you provided a copy of the agreement to the new headmaster to show what was agreed previously.
