  • CCJ- wrong address

    Hello,
Last week I received a letter from a debt collector regarding an unpaid CCJ. After many phone calls I’ve found out I had an unpaid parking ticket from 2022, there was a court judgement in Dec 2024. The letter I have received was already outside the 30 day window, so now I have no chance of paying and it being removed from my file, without a set aside.
Basically, in the last 2 years I have lived in 4 places, so the letters never kept up. The letters regarding the ccj were sent to my last address and I can prove I updated my VC5 form at the time of my move, so had no way of knowing. However, I cannot prove I updated my VC5 after the offence in 2022, looking at my emails I didn’t update until 2023, so that would be my fault for not getting the initial letters about the parking fine.
My question- do I have a chance at a successful set aside as I was not aware of the recent court proceedings, or will it likely come back at me for the first error of not updating the address? Anyone with experience please let me know, I’ll pay for the set aside as I mainly want the CCJ removed

Hey Mugsmalone, Ive literally just gone through exactly the same thing, parking ticket from Dec 22, I moved address in Nov 22 so all post went to old address then I found out in Oct 24 I had a ccj. Got my court date in March to get it set aside. Ping me a message, more than happy to walk you through the whole process with the n244, witness statement and draft order.

There have been instances in the past of posters trying to advise via pm and charging for the information. It’s therefore recommended to keep advice/help on the original thread. That way you not only help Mugsmalone but also anyone else who has a similar issue and finds this thread in the future.
