  • Set aside application

My set aside application was filed in CNBC by my solicitors.
A writ of enforcement was stayed in the high court pending the set aside hearing.
The case has been transferred to Romford county court with a hearing date.
i am now a litigant in person.
in the county court bundle, are the documents filed with CNBC valid eg n244 form?
do I need to produce a witness statement if no new developments in the case?

    Hi
    Welcome to LB

Yes the documents already filed are still valid.

You should write a witness statement to explain the grounds on which you are applying to set the judgement aside. Your statement should list the steps in chronological order that you have taken since you found out about the judgement. If the application has been delayed state the reason or reasons why this has happened

There is an example of a witness statement under "Witness Statements" on the right of this page

You should send documents to the county court and a copy to the claimant

If the court agrees to set aside the judgement you will probably be given a deadline to file your defence to the claim
