  • Lowells Hassling Me For Very Old Debt

    Hi all, long story short I had a CCJ with Hoist in Jan 2018 for a Barclaycard account. They've never contacted me in the 7 years since and today i got a call from Lowells chasing me for the debt. I told them that it was over 6 years ago and therefore statute barred but they refused to accept that and said that they would write and call until I paid.
    Online searches suggest that theyre out of time unless they can get the CCJ extended.
    What are the thoughts of the Beagles?

      Once they've got a CCJ the debt can't be statute barred.

      They would have to return to Court and need a 'very good' reason why they haven't gone to Court earlier to pursue the debt.

      So still 'hurdles' for them to cross.

        Thanks pt2537 and echat11 , that's much appreciated. PT, I read the link and unless I misunderstood it noted that the court allowed them to pursue the debt (but not interest) on the basis that the debtor had been overseas thus not contactable. It seems that leaving the country stops the clock on the 6 year term for contacting a debtor... interesting.

        I've always been at the same address and on the electoral role. Could Lowells lack of contact in 7 years potentially pose a problem for them proving they had a very good reason?

        Also, if they keep hassling me but without going to court, is there a stage at which it could be deemed harassment?
