    Hi All - I have worked for a company for the past 10 years - I am a self employed consultant invoicing once a month - payment due on the next working day. For a long time it has worked well and I was paid on time. However things have changed and I have had to fight for my money for half of 2024. I have stopped working for the company now and am owed a considerable sum (11,000) and have taken the company and the sole director to court. I am still owed money from December all attempts to get this paid have been ignored. I have one of their vehicles at my house and a laptop and some office keys. The question is what are the next steps for the December money? How long do I have to wait until I can sell it if at all? I am going to move it from my road soon and take it to some land that I own. I am looking to charge the company for this. What is reasonable and just? I only want what is legally mine and what I have worked for. Thank you

    You would do well to consult a solicitor in respect of your various issues, most particularly extracting payment.

    What do you think the value of the vehicle might be?

      Hi

      The vehicle isn't worth much probably about as much as I am owed for the December invoice. The other monies sit at the County Court where the defendant has asked for more time to respond.

        Please read EX303 "A court claim has been made against me" published by HM Courts and Tribunals Service
        A defendant has limited time to respond to a court claim, admitting in full, admitting in part, or denying and defending

        If a defendant fails to reply to the claim in time, the claimant can apply for judgement by default
        You should make note of the date your claim was served and count the days
        If the company files a defence you should be sent a copy

        Do not sell the car. You need to be the owner, otherwise it would be illegal if you did not have the owner's permission to sell it

        Nor am I convinced trying to charge the company for storing the car on your own land would be successful in court.

        Have you checked the Companies House register online to find out the company's financial position?
