  • Enforcing a court order in Spain

    Hello we’re hoping someone can advise us on a difficult situation. We have a court order against a builder who took a deposit for building work but never carried out the work. The order is against him personally not the company. He has ignored the court order and has not paid us. The difficulty is he has now fled the country and lives in Spain. We also believe he does own property. Having spent a lot on legal costs to win the case we are loath to spend out more.

    All I can tell you is that the procedure for obtaining a certified copy of a judgement of a UK court is set out in CPR Part 74, Part II and in Practice Direction 74A.

    You will need to making enquiries of the process in Spain for enforcing that judgement.
