  • Can a debt collector add a charge (for non marital debt) after Final Divorce order?

    My daughter's divorce was finalised in December (having been separated since April 2023), and a Court order granted with regards to the split of the equity in the former matrimonial home.

    The house is sold subject to contract.

    The conveyancing solicitor has just confirmed that the Land Registry has an application pending by a debt collection firm (Mortimer Clarke Solicitors Ltd). This is relation to her ex, and is not a marital debt.

    It seems unfair that my daughters share of the equity could be reduced to satisfy her ex's non marital debt.

    Are there any steps she can take to oppose this debt firm's application to the Land Registry.

    I / we would be grateful of any advice

    Surely this should come out of the ex-husband's share of the equity.

    And yes, your daughter can object. Her solicitor can advise.
