    Good Morning

    I purchased a new car, well it was a second hand car, but it was new to me.
    It was from a small dealer close to my town.
    it had a full service history, good length MOT ans was immaculate.

    on day 2 of driving, a sensor fault appeared, so I rang the garage up as when I purchased it, a 30 day warranty was supplied. So I drove it back after seeking advice from them and they said it was safe to drive.

    when I got there, they put the error code reader on it and said nothing was showing, and if it came back they would order the part and fit it.

    The next time of driving it appeared again, so back on the phone and arranged to take it back in. They placed the code reader on again and it showed this tome and they ordered the part and I was to bring it back again. So in the first week it had been in 3 times.

    The sensor was fitted and all seemed fine. I had it for a further 2 weeks with no errors until I was driving to work one evening, and a gearbox error showed up and then disappeared. I stopped the car and messaged the dealer. They advised me to try and start the car, which I did, and asked if it seemed OK, it did and they advised it was OK to drive. They told me with it being an automatic that small errors can occur with all the ECU and that they can reset themselves. She said the call had been logged and that it would be covered in the warranty as I had reported it to them.


    I beleived this as I'm not a mechanic.

    A week later when driving home from working a night shift, the car was driving horrendously, gears kept jumping, so I limped home luckily it's not far and I managed to get it to my garage.
    unfortunately they weren't open that morning so I called the RAC and they came out and ran diagnostics, he basically told me the gearbox has gone and it wasn't moving.
    I called the dealer and explained what happened, he asked me to send the report from the RAC which I did and I asked my garage to do a diagnostics scan on it which showed up that the gearbox needed rebuilding.

    I ,of course, rang the dealer who said that I would need to get the car to them and they would send it to a gearbox specialist as it was past the 30 day warranty period.
    I explained that I had reported the gearbox error and that I had the messages and photos.
    He admitted this, and arranged a collection of the vehicle to be taken to an automatic specialist.

    I was told it was a major job, but it would be covered, but it could take time. I emailed to ask a time frame after 2 weeks of them having the car. In the meantime I had to purchase a small run around, as I work Nights and also have a terminally ill father ,who I need to be able to get to, as he really is very sick.

    4 weeks and they said they would be in touch by the end of the week... 5 weeks of having the vehicle ,I messaged them and asked for an update, they said they were driving to pick it up and would let me know when I can pick it up.
    I messaged again the day after and was told on the drive back, it was juddery so they took it back.
    I gave them another week and on week 6, I messaged and explained they had had the car in their possession longer than I had owned it.
    They explained it was due to be collected and I received a call to say it was ready for me to collect. This is 7 weeks after first being collected by the car transporter.

    I arranged for my husband to go and collect the car a week before christmas, when he pulled up with a colleague who's a mechanic, the bonnet was up and he was told there was now an issue with the starter motor!!!!
    I am at the end of my tether, I am currently insuring 2 cars aswell as taxing them. I understand under the Consumer Act that I had to give them the opportunity to fix the fault, they fix one and another crops up.?? I just don't know where to go with this, I have explained to them I have lost all faith in the car.

    I apologise for the long post, I don't know my rights and was hoping for some advice.

      In your 4th paragraph you reported a fault with the gearbox to the dealer. Was that within 30 days of purchasing the car?
      You have a legal right under CRA 2015 to reject the car for a full refund. You should write your letter to the dealer today, obtaining proof of postage
      If you have the dealer's email address you could also attach the letter to an email
      There is a template letter to reject a faulty used car at which.co.uk
      If the dealer refuses your rejection and you didn't pay a deposit (or in full) by credit card, you will need to make a court claim

        Thankyou for the replies,
        I paid for it via bank transfer and yes it was within the 30 days.
        it's just been a minefield , I have been so fed up with it all, I really appreciate your advice.
