    I have received a Letter Before Action but my instinct tells me it might just be a 'fright letter'. My solicitor has my agreement to proceed on our behalf but requires a large 'payment on account' before any action will be taken. If my solicitor responds to the LBA for a postponement to our response and the claimant abandons their claim, will the payment on account be refunded ?

    That is a question for you to ask the solicitor. Normally a solicitor would take his fees out of money his client has paid on account. There might be a balance to be returned to you.
