I am in the process of purchasing a residential property. It turns out the family are selling it without 100% relevant paperwork. They have other POA but not to sell the property without the courts specific permission as I understand it. Their solicitor said 'no need' when spotted, mine said definitely a need. There is a history of court applications from the family for progressive levels of POA. I have now been waiting for 2 months approx and still am told they are waiting for the court reply. My question is... Should the property have even been listed in the first place? It have obviously incurred solicitors fees etc along the way.? (I put my solicitors on hold for now as I didnt want to pay more for nothing) Whats the process for retrieval.? Thanks in advance for any help.
