  • Hi all

    I have a number of unsecured defaulted debts, all of which are now in the final year of the six SB. I have never acknowledged or responded to any of them.

    I recently got a letter from one of them threatening CCJ, I wanted to know what I can do to hopefully pull through to complete the six years without falling at the final hurdle.

    The background to the debts and why I have avoided paying them. A sibling used my name to take out innumerable loans etc, during a time when I was at my lowest mentally and vulnerable.

    Sibling passed away and although I had no way to prove this happened, I also have not had the heart to do so.

    Now I am within one year of reaching the six year default, I am getting letters threatening CCJ.

    I would like to point out that I have no assets and have been patiently waiting for this to end so that I can finally build my credit rating back up and hopefully get a mortgage in the future.

    I am a 50 yrs old, married with two kids. I can't wait another six years before I begin to build life with and for my family.

    Any advice on what I should and should not do would be really appreciated.

    You need to hope that court action is not commenced before the expiry of the respective limitation periods. In the meantime, do not pay anything and do not in any way acknowledge the debts.

      Thanks for your swift response really appreciate it. In essence , I need to hold my nerve (not respond in anyway) and hope for the best.

      If however, I get a letter from the court in that time, I assume them, I will need to respond?

        Your assumption is correct. Not responding to anything received from a court is asking for trouble.

          Thanks again, and definitely will not ignore the courts, albeit hoping it doesn't come to that before SB period
