Hi. I have a Deed of Trust registered as a restriction on the land registry against a property. Should this remain valid against those who inherit it ie the legal owners children? It concerns financial contributions I made for refurbishment, and restricts the sale and distribution or rental income. According to google this should work if it's not requiring a positive act, but a solicitor also told me it would only be enforceable against the current owner referred to in the Deed. Would be grateful for any clarification on this. thank you

I share the solicitor's concern. Can you please post the wording of the restriction.
If at all possible, I would advise obtaining a charge over the property.Lawyer (solicitor) - retired from practice, now supervising solicitor in a university law clinic. I do not advise by private message.
