  • Starbucks parking scam at Stansted MET parking services

    Hello I see many others been cause out by this scam. I was not the driver but the driver parked at starbucks after closing and popped into McDonalds for 20 minutesand subsequently received a parking ticket... I have appealed to MET but naturally no help so wish to appeal to POPLA. I s the following for the appeal but can you help further so I get the wording right...
    I would suggest you appeal to POPLA (https://appealform.popla.co.uk/#/StartAppeal/Index)

    You will need to show (i) (by means of photos and a site plan) that the signage was inadequate to form a contract
    and (ii) that the NTK failed to comply with the requirements of POFA2012 to transfer the driver's liability for the parking charge to the keeper (as mentioned in the letter you sent to MET)

    Before sending you appeal post it up here so we can advise further if necessary

    Hello beagles i have received two further chasers from the MET debt recovery company . So far i have not responded further to my initial appeal sadly stage 4 cancer has become my focus but I am happy to go to court.
    it remains
    1. I was not the driver
    2. lighting and signage was inadequate
    I have since taken a photo

              Sorry to hear of your health problems.

              Regarding the parking Charge, it is now too late to appeal to POPLA, and there is no point appealing to Debt Recovery Plus as all they want is your cash.

              You will eventually receive a court claim.

              The mainline of defence will be that as you were not the driver the only way they can transfer liability for any unpaid charges from driver to you is via the provisions of PoFA 2012.
              However in this situation that is not possible because the area , being airport land, is subject to statutory control and is not "relevant land" (to use the wording of the statute.

              The solicitors acting for MET will likely, after huffing and puffing, discontinue the claim. Sometimes they just don't turn up at court!, but if they do you should win.(but do be aware it is a bit of a lottery ... depends which side of the bed the judge gets out )

              Come back to this thread when you receive the claim form.

                hello i know this post is old Oct 2024 but i have just received a LETTER OF CLAIM dated 19 Sept and it gives 28 days to reply, should I be worried?

                      Dear Sirs

                      I am in receipt of your Letter of Claim, ref xxxxxxxxx dated dd.mm.yyyy.

                      I write to advise that I do not admit the claim, and assert I owe your principals nothing.

                      I was not the driver at the time of the alleged event, and as the land was not relevant land as described in the Protection of Freedoms Act 2012, liability for any unpaid charges cannot be transferred to me, the registered keeper.

                      I do not expect to hear from you further except to confirm you will not be proceeding with this claim.

                      Yours etc.


                      They probably won't take any notice of it, but will continue to pressure you in the hopes you will cave in!
