    Dear Legal Beagles,
    Hello and thank you for letting me join Legal Beagles Forum, we have an issue with our local council regarding our property boundaries which we have had surveyed by two companies that deal with boundary disputes, in particular the Highway 1 meter service strip. The boundary line has continually been eroded by traffic so much so that the true boundaries are not represented visually. As such a significant amount of our property has been lost. The dispute centres around our hedge line which we are told encroaches on to the highway service strip however the area the council refer to has long gone and this 1 metre service strip we are told moves and is now within our hedge line, we maintain our hedge within the surveyed boundaries as the area is unsafe to maintain in any other way due to the lost ground. We are now seeking legal representation due to the threatening nature of the emails we have received from the council. Can you help please?

      As you are seeking legal representation, what assistance are you looking for from a forum?

      Boundary disputes are complicated enough if with neighbours, but when the highway Authority becomes involved it can be a nightmare (don't ask how I know!)

      The basic problem is that the highway generally extends from hedge to hedge.
      If there was a verge between the hedge line and the metalled way, that verge (unless clearly delineated) is generally taken as part of the highway.
      If the hedge is allowed to grow outwards and cover the verge (to recover lost land) the council can become upset.

      Not sure what your situation is, but a boundary dispute solicitor should be able to at least clarify the position for you
