  • Adverse possession dispute

    We purchased a property in 2022 which the previous owner had lived at for 12 years. There is a stream that runs through the garden which was part of unregistered land. The previous owner and the one before him fenced it off and maintained the area and stream as part of their garden, which we have been told we have adverse possession over together with Riparian rights, we have now due to harassment applied for Possessory title . Since we bought the property a group of neighbours have caused us endless problems including damage to our property and verbal abuse resulting in a Police caution. These locals say that we should relinquish the stream and have waged a campaign of harassment since we bought it and which we are now going through civil litigation.
    Our solicitor has sent a Letter of claim to each of the individuals. One of them has instructed a legal firm that carried out the conveyancing of our property when we bought it 2 years ago. My question is does the defendants solicitor have a conflict of interest in acting for them?

    Welcome to LB

    I think there would be a 'Conflict of Interest' in so far as they would have access to 'conveyancing file / documents', that could be used against you. As to whether they would use that information or not is another matter. That might be why they were chosen.

      Did this firm give you any advice on this situation when you were their client?

      It is possible that this firm has a conflict; equally I can see circumstances in which there is no conflict.

      And you chose not to instruct them in the present matter.
