I am hoping someone can help.
We are having problems dealing with Templeton LPA Receivers who have been appointed by The Mortgage Works.
We are in dispute with TMW over any alleged arrears and The Financial Ombudsman has found that TMW have not been helpful in resolving the issue with their persistent delays in responding and providing information.
Nevertheless TMW still instructed Templeton despite the ongoing investigation and dispute. They are currently trying to intimidate and harrass our tenant, including sending a white van with two rough looking men who interrogated and threated her daughter who is under 18.
We believe the appointment of Templeton is invalid. The Deed of Appointment has not been correctly executed. We have asked TMW since February to clarify the points we have raised and so far have not received any response. Their legal dept even claimed they did not understand the question:

25 April 2024 - "The appointment/Instruction of LPA Receivers is a legal transaction of some significance. I wish to know who is authorised by The Mortgage Works to carry out this duty on behalf of the institution/body that is The Mortgage Works. Those individuals would be given power of attorney to carry out this legal task.
The deed of Appointment is a legal document and as such should be signed and witnessed by the authorised party.
I want The Mortgage Works to provide an answer to confirm that is the case."
To date we have received no response despite several requests.
Does anyone have any experience of this situation? or advice?
