  • GDPR Breach or nothing?

    Good afternoon all.

    Thank you for taking the time to read this any help advice aporeciated in advance.

    Right (asking for a friend, i know but its true) years ago he made a mistake and commited an offence which ended in a custodial and will never be spent. From then on no more mistakes always worked and 30 years on settled and stable. His current workplace was made aware at interview stage and no problems.

    The employet is expanding and has taken on a government contract which involves entering a naval base on occassions. Pretty sure he will need clearance and will be refused.

    Now, the hierachy is as usual operations manager, manager, supervisor, team leader and operative.

    Once he is refused theres a 100% chance the team leader and supervisor will make this clear to every other operative etc when it happens.

    Would this be a GDPR breach? Although its a you did the crime sitiation etc that part of his life is behind and could do without it being dragged up again.

    Due to work rotas theres no way they can not be told and there would be no reason for other operatives to know or be told.

    just intrested in the legalities surrounding this and options ifvhe is ultimately made to feel uncomfortable in work due to this.

    i accept a few will say, own fault, deserves it, catches up with you etc etc but lets try and be a little constructive please

    This would be considered personal sensitive information. If clearance is required and if his is refused, I would suggest that he heads this off by speaking with HR to get them to ensure that this is handled with the sensitivity that is required and that the people who are made aware of this situation is limited.

      Why are you so sure? Has someone in management/HR warned him that it might happen? Suggest your friend waits to see what happens before assuming that. 30 years was a long time ago. Obviously it depends a lot on what the offence was (but please don't post details here).
