  • Getting car out of parking space

    We lease a parking space from the freeholder. Someone else has moved their vehicle into the space, and shows no sign of moving it. Vehicle owner does not respond to approaches, and freeholder (UK incorporated but run from Thailand) denies responsibility to do anything. Any suggestions?

    Stop paying the rent for the space. Tell the freeholder why.

    Or sue the person parking the other vehicle for damages for trespass.

      Thanks. Freeholder has made it clear they will sue for the rent, and based on their track-record I believe their threat is credible. Suing the vehicle owner is certainly an option, but they are a large corporation who are very cagy about providing relevant addresses. We will try Small Claims Court, but I suspect it would cost us a great deal to take on their legal team (and find a lawyer willing to take it on).

          In small claims court the loser does not pay the winner's legal costs.
