In Dec 22 a judgement for £10k was given against a tradesman who overcharged me. He never responded to the court papers. In late 23 I instructed bailiffs. In May 24 he made application to set aside & now that is a ‘Defended Claim’ . If the judgement is set aside does that mean I won’t be in the list of creditors- his Ltd company entered insolvency also Dec 22? I think he is personally liable as sole director as he instigated the charge (tripled) ie he is joint tortfeasor with ltd company. The firm is still operating same vehicles/numbers… have I any chance of defending the original judgement or can he hide behind the company??
