  • C/C Debt.

    Grab a coffee Where do I start? A family member X applied for a C/C. way back in 2004, Granted, the issuing company, in 2007 decided that they would dispose of all that side of the business, and so X debt was sold to Debt buyers in 2007, X was almost instantly taken to Court for default, by the debt buyers and they obtained Judgement, as X did not defend(Non-appearance), A Charge was placed on the property? I believe that is not allowed. X Then requested I look into the account, first I said were are your yearly statements?, there were none, and so I contacted the Debt buyers, knowing the account had been purchased by them for 12 years, after many requests, they sent the accounts, on buying the debt, the first month they added compound interest for 12years, this was illegal as they already had a judgment against X, X contacted the Financial Ombudsman, they the debt buyers were ordered to repay over £4.000, I am now at this stage with the original creditor, SAR, in fact, many applications before a reply was returned, showing no useful information what so ever, the account is impossible to decipher, they have stated that they no longer hold X acceptance agreement, but the application form, now from memory there was a case on Legal Beagles stating that a Company must retain the records ?.X has not defaulted as far is I can see and was paying the interest to the original lender, and so not in default, X did not receive the notice that X had the option to pay and clear the account before being sold. The agreement rules are so small and smudged I impossible to read them, I feel that X has a case for appeal ?.
