I've recently been contacted by a company acting on behalf of my neighbours insurers saying a tree on my property has caused subsidence. They have recommended that my tree be removed which my husband is very loathe to do. There are numerous other trees in neighbouring properties but these are classed as not the problem as they have preservation orders on them. I have been told that if I choose to do nothing my neighbours insurers will repair her home but any subsequent damage I will be liable for as I have been put 'on notice'. If I chose not to fell the tree and problems do result later on down the line will my public liability on my home insurance cover this?

If you really don't want to remove the tree you could get a report from your own expert as to whether they agree with your neighbour's insurers about the tree. If it is a risk to your neighbour's house is it also a risk to your house?All opinions expressed are based on my personal experience. I am not a lawyer and do not hold any legal qualifications.
