My partner was hounded by these people for years, sending him invoices constantly for so called "work" that they did. When he approached them, or tried to, he could not access his account online as they had "logged him out". Couldnt phone them either so that he could find out what all the charges were for. He then applied for a SAR (via email) and they ignored him. Next there were bailifs at the door and he has had to pay them, they were not too kind either. How on earth have they managed to do this to someone and take money from him, that he didnt owe in the first place. Can anyone help?

The first thing we need to establish is whether Bank Smart obtained a court judgement by default (possibly without you partner's knowledge) and they were actually bailiffs enforcing the amount or whether they were just debt collectors. Can you elaborate?

Thanks for your reply, as far as I know, they were enforcing a high court writ. My partner did not know of the judgement. Even after the bailiffs had contacted him, BS carried on hounding him. I then gained third-party authority from my partner to speak to the bailiffs and explained to them that he was still being contacted and hounded by BS. I will today, ask my partner to email the bailiff company and ask for a SAR from them.

He could have applied to have the default judgment set aside but if he's paid it now that would be very difficult.
Do you know what Bank Smart were saying the amount was for? If it was for anything other than commission for a successful PPI claim (like cancellation or breach of contract charges) then they were specifically banned from pursuing such charges.
