  • Drug driving query

    Just been caught drug driving (measured 4, 3/4 joints a night) and as a self employed courier with a potential 12 month ban who rents a flat and has 2 small children that are dependent one me - what can i do if i can't drive for a living? With a criminal record can my landlord kick me out?

    In terms of a job all I can say if you are banned from driving then you are left with trying to find a job where you do not need to drive.

    If you are an existing tenant then likely they would not know if you get a driving ban however if you do not pay your rent, then they could start proceedings to evict you.

      Read you tenancy agreement and see what it says, if anything.

      If the agreement doesn't require you to disclose criminal convictions, and if the landlord doesn't ask you (eg when your tenancy is next due for renewal) then you are not obliged to disclose it. But if the landlord asks you must disclose and it might be a reason to evict you. Get professional advcie if it ever gets to that point.

        Sentencing guidelines below. You will have a chance to tell the court about the impact of a ban and ask for it to be kept to a minimum. Bring proof - the mags will not just believe that you drive for a living or have responsibilities etc
