    The Claimant has 28 days to respond to your Defence, in the meantime you might receive more information from the Claimant. The Court will send a Directions Questionnaire.

    The Court will send out Directions to the Parties. Then you state whether you want Mediation or not, that's dependent on if you receive all the documentation or not. If it isn't settled at Mediation, then the matter proceeds to a Hearing. Exchange Witness Statement 14 days before Hearing.

    The Court still expects the Parties to try and settle the matter without the need for a Hearing.

      Morning! So it has been 28 days since the court letter arrived regarding my defence there has been no contact off anybody apart from LINK sending back my £1 postal order stating they no longer need payment for the CCA request.. whats the best move now?

      again thankyou for everything so far its been incredible!

        See if they (Claimant / solicitors) respond over the next week.

          Hello so it has been a week I have still not received anything off anybody.

          I know MCOL is poorly monitored as i have read on here but i have been checking it daily and no updates there either what is the next port of call ? many thanks

              Afternoon,
              I have spoken to the courts after waiting on hold for 2 hours! they were no help... they said i need to wait for the mediation letter to arrive? so then what is the point of giving the claimant 28 days to reply? basically this becomes open ended?

                O.K. the case is 'stayed' as the Claimant hasn't responded to your Defence. So the Claimant has to go back to the Court to lift the 'stay'.

                You haven't received a Directions Questionnaire, the case is 'stayed', so very unlikely that you will receive a 'Mediation Letter'.

                You don't need to do anything at this time.

                      I could be wrong but I thought the Reply to Defence was returned with the Claimant's DQ, so no 28 day time limit
                      The claimant does not have to file a Reply to Defence

                        Quite correct, normally the Claimant does respond within several weeks of the Defence when they send out a Reply with their own Directions Questionnaire, as to how they view the Defence.

                          so you think they could still come back with trying to go ahead with the claim? they don't need produce evidence/ file a response? sorry if i have mis understood

                            Yes the claimant will probably still proceed
                            Witness statements and evidence do not need to be filed until a few weeks before the date set for the final hearing

                              They can Reply to your Defence at the same time that they file their Directions Questionnaire.

                              Will they carry on with the Claim?

                              They may or may not, they look at things from a costs perspective and have they got the documents to proceed.

                              Distract yourself when you think about it, update the thread if / when the Court or solicitors contact you.
