I am renovating a property in Derbyshire. It’s a detached cottage but the (integrated) garage wall forms the boundary with my neighbor’s driveway. Part of my renovation involves putting scaffold around my garage, hence on my neighbor’s driveway. 1.2m width on a driveway that is about 5m wide. I asked my neighbors if this would be okay ahead of applying for planning permission; they said it would be. In numerous conversations I have had with them since they have continued to be agreeable. However, now the time has come to erect the scaffold, they are not allowing it, saying they don’t want the inconvenience. I have subsequently discovered they are tenants in the property. I have approached the owner, their landlord, who has granted me permission to erect the scaffold. But my neighbors, the tenants are still saying, as paying tenants, they can refuse. Who is in the right? If the landlord has given us permission, can we just erect the scaffold regardless of the tenant’s objections? The whole renovation has been sympathetic to the neighbors and the scaffold will not impact their access at all.
