  • Transfered claim for hearing

    Hi all,

I have rather unusual situation. Myself and my husband got claim against us both. We were assigned only one claim nr thats why we put defence together. Somehow clerk overlook that and assigned defence only to myself but not my husband. As a result husband got CCJ in default despite submitted defence. Court clerk admitted error while processing the defence. Great, but how I gey ccj removed. I was adv file is with district judge for judgement but sadly judge didn't give directions to remove ccj but only transfered claim to local court for hearing. Am I correct thinking that case is not decided yet? If so how one can have CCJ for sth pending?.we have submitted N244 on numerous occasions,.2 of them got lost. I have again resubmitted. I have paid for N244 long time ago via phone but have realised I go no written proof. My question is do I pay again for N244? Or somehow courts communicate with each other? How do I remove ccj entered in error. I'm so distressed over 1 year and still have not managed to solve it. Now I wish I paid the claimant instead of trying to proof I'm right. Pls kindly give me some ideas how to go forward. I have hand delivered N244 to new court document supporting my case.thank you

Correct. Your application is to be heard at your local court. It will be decided at that hearing.

There is a section on this in the guide for LiPs - link in my signature.
