    Hi Hope you are well. I requested a CCA through Lowell for a Barclay card debt and they have sent the short form cancellation and historic terms and conditions and the letter states that they are unable to supply the varied terms and conditions. Is this sufficient. Thanks Regards

    As it stands the agreement is 'unenforceable'
    They should provide a copy of the agreement 'True' or 'Reconstructed, dependent on the date when the agreement was taken out. The agreement should have prescribed terms i.e. APR, Credit Limit etc on it as well as name and address. They should also provide copy of Terms and Conditions if the agreement has been 'varied'. At some point you may want to request they send a copy of the default notice and letter of assignment.

    You could send a follow up letter stating that they haven't complied with you CCA request under the CCA 1974. Make sure you get Proof of Postage, they should comeback with you still owe the money, but the debt is 'unenforceable' as they can't provide the requested documents.
