  • Is This Misuse of My Data?

    Hi all, I have a dilemma with the managing agent that runs our residential building. A while ago they started a portal so that we could collect our service charge bills. Our leases state that service charge demands and annual accounts must be delivered to the property so I emailed them to tell them that I didnt want to sign up to using the portal and insisted they send me paper bills. BUT... they continued to email me alerts every time the service charge was due telling me to logon to the portal and retrieve my bill. The portal also send me weather reports via email. I've asked them to stop these emails multiple times but they keep on coming.

    Yesterday I received several emails alerting telling me about their new super duper portal so I called and spoke with their IT team top ask them to stop. I asked if the new portal was a third-party app since I wouldnt be happy with them sharing my email address with another company without consent and they insisted it was in-house, however today Ive foudn out that the portal is now run by MyPlace.

    So it seems that the managing agent has passed on my details against my wishes and im now being harassed with spam emails. Is there anything i can do?

    File a complaint with the ICO.

      Before you can make a formal complaint to ICO you need to have made a written complaint to the managing agent

      The second link includes a template letter.

      But you can speak to the ICO informally first and get their view on whether there is likely to be a data breach which will help you draft your letter to the managing agent.

        Thank you both for your replies. Ive previously, repeatedly, moaned at the managing agent re the portal and daft weather emails, so my complaint that I dont want anything to do with the portal is on record. Today i send a new email copying in their data controller, will check the ICO website over the weekend.
