    Hi.
    I used a SIP car park last November recommended by the hotel i was staying in,it was for one night so 24 hours parking was fine i parked my car at 1.15pm i tried cash first to no avail so i tried my debit card 3 or 4 times the machine kept saying declined by this time a queue had formed, a few other people tried cash then card they had no luck either i then decided to phone the helpline the number on the notice board to see if i could by phone but it was a automated service saying i could not pay by phone so I walked back to the hotel which was about 400 yards away i told them the situation they said try downloading a parking app which I did.by this time a half hour had passed i then booked the parking for 24 hours at 1.45pm.I came back to the car the next day around 1.35pm so i was in my 24 hour parking time.2 weeks later i got a £60 parking fine saying i was 26 minutes over my 24 hour period.I tried everything possible to obtain a parking ticket at the time i drove in but it was out of my hands i appealed and my appeal was declined they said i could appeal again through IAS which i did but my appeal was also declined by them aswell saying i was 26 minutes over my time.i think this decision was totally unfair i still have not paid the fine which has risen to £115.Do you think i should bite the bullet and pay or take the matter further any help would be appreciated.Thank you mitchy

    Well you do have the makings of a defence, but whether or not you want to chance court is your decision.

    If you want more help can you post up the parking Charge Notice and photos of the signage .

    I suppose you have identified the driver

      Yeah I'm not sure I want to go court but still annoyed that I have to pay as it was out of my hands.
      I've attached the PCN letter and I haven't got a photo of the signage as i thought it wouldn't go this far so ive attached 2 photos one that's identical and one of the original car park but you can't make signage out so they are probably no good.ive also attached a screenshot of my mobile record that I rang them twice but it was automated service and you couldn't pay..I have screenshots on my phone of time etc downloading the pay by phone parking app times and dates.

        OK so surprise surprise they turned down your appeal, but have they given you the code to appeal to an "independent" organisation (either POPLA or IPC)?
        They will probably turn down your appeal as well!
        (they are not truly independent)

        If you don't pay SIP might well try their luck in court, where a different outcome is possible.

        A judge could well be open to a defence of "frustration of contract" on the basis that their faulty machinery prevented the contract being struck.
        It would take some working out to frame it properly as a defence.

        If SIP make an error and claim against you as The Keeper rather than as driver of the vehicle then they might run into possible problems because of faults
        with the Notice to Keeper:
        1) do the bits you have covered specify the vehicle, and date of issue of this notice? Is the date of issue with 14 days of the parking incident?
        2) location not sufficiently specific : Pollard Street is nearly 1/2 mile long & covered by 12 postcodes

        Up to you to decide if its worth the stress and time to defend

          Yes after sip declined my appeal they put me onto the IAS and they knocked me back aswell saying exactly the same..thanks for help il have a good think about it. Cheers

            Actually they never gave me a code to contact popla etc..when you say court to have to Actually go to court or is it online.thanks

              The IAS and the ADR (which is the IAS) are affiliated to SIP. You’ll never win an appeal against the operator, I think your biggest problem is they also supplied details of the Parking APP which is 24/7 accessible. I would safe yourself the stress, forget your pride, accept they are all TW**T’s and just pay it
