False Assault Reported by Neighbors and we are in Deep Trouble

    Understood! Thanks again!

    One other request. As mentioned before, my partner is planning to submit a written account of the incident to the Investigating Officer or the Police Station that it is not an assault in case it helps them to stop proceedings at this stage or at least as a supporting document for CPS when they review.

    But she is not sure of the format and what to write and what-not to write. Any direction on the examples that can be found or shared anywhere here or outside please.

      I don't have any but someone else here may have. Just tell the truth. Sign and date it, ensure there is an address and telephone and email contact details. I don't know what else to suggest. Has she been asked for a formal statement?

        Many thanks for continuous replies. Yes, that is the idea. To summarize the truth, sign and submit.

        She was initially asked to give a statement against me but she declined. We are wondering if that was chance to give a statement in support of me to avoid all this.

          She could have made a statement saying there was no assault. She will probably be called to give evidence if there is a charge followed by a trial so can say what she wishes at that point.

            Yes. Exactly. She was keen to give a statement when the officer came to our house that there was no assault. But the officer wanted her to give a statement only as a complaint but not against the arrest. They took some declarations as part of questionnaire but not a statement.

            We keep thinking that it was a miss from her at that time which would probably have helped us now. That is the main reason she wants to submit a written statement now.

            And we are keen to stop this from going to trial or even CPS if possible. Hence this plan of submitting a statement now.

            One other question - If we want to submit such a statement at this stage, how do we approach. Do we go meet the investigating officer and hand it over OR submit at the police station OR through a solicitor to the investigating officer. Any thoughts please

              I must admit I don't know the answer but perhaps ask the Police. As I have explained it MAY help but I have seen prosecutions where the alleged victim said there was no assault but there was still a guilty verdict. You have little to lose I would think. Sorry I don't know the full answer - someone else may?

                        This case is going to be a waste of the CPS's / police's time.

                        Maybe contact the CPS through a solicitor or directly.

                        Minimum, get some pro bono advice, 30 minutes free from a solicitor.

                          I have no experience in this type of situation, but I would opt for sending the statement via your solicitor, or at least with his knowledge and agreement to its content.

                            As we understand, the officer hasn't submitted the final report yet to CPS. echat11 rightly said it. He is not focusing much on this as it's sheer waste of time but he is not dropping the case either. Not sure why. That's why we were thinking..                             But can we go ahead and contact CPS even before he submits. And as I see from the link https://contact.cps.gov.uk/, the closest relevant options are I want to make a general enquiry OR I want to make a complaint. I am assuming the first one as making a complaint may not go well with them

                            On this, any agencies, organizations that you suggest? I tried Citizens Advise and Law Society and they weren't of any help except pointing to local Solicitors.

                            We did talk to a proper solicitor firm and waiting on their formal letter after a long call of explaining the whole story.

                            Their advise is to submit a Section 9 by my partner and representation from me. Still awaiting the details. Probably they are finalizing the Rip-off plan

                            And yes des8, we are looking to get any standard template from this forum or review the content that we already prepared with a solicitor and then submit, either at the station or CPS.

                              Try Googling the following :- 'free 30 minute legal advice drop case cps'.

                              You could pop into the police station where the officer is based, they should have a 'counter/ helpdesk', you get to speak to someone different, explain what's happened, say you've popped in to hand your statements and explain that you don't want to waste their or the CPS's time, as that's what it will be.
