Hi, I have been getting letters from Lowell asking me to call them, which I have so far ignored. The reason for ignoring them is because I have never taken a loan or signed for one. My husband had a debt from a loan he got from a Company. I believe that Lowell acquired the debt. My husband had an agreement with the previous debt owners, and has been making regular minimal monthly payment. Lowell used to write him and me; however they have recently begun to write just myself. My husband has telephoned them to advise that he is the debtor and not me. He only provided my details when he made the application for the loan as his wife. It is the same reference number on the letter that they write to me that he also has. He tells me that when he has tried to log into the account with his name, that he is unable to log in. It seems that Lowell is trying to ‘hang’ the debt on me, even though I had never asked for or applied for any loan. This is really getting frustrating as they are threatening to involve their debt collection company. What should I do please?

Firstly, don't speak to them over the phone. Secondly, if you write to them, make sure you write 'Without Prejudice' on the letters, so you are admitting nothing and they can't be used in Court against you.
When was the loan taken out?
When was the last payment made? Was it in the last 6 years?
Has there been any written communications in writing admitting the debt in the last 6 years?

The loan was taken out around 1999 or 2000 by my husband. There had been an agreement between my husband and the people that he would pay an amount evry month. Lowell bought the debt in April or May this year. Shortly after they started sending separate letters to myself and my husband, although the debt account was the same. I notice that their reference for both of us was different. Over the last 2 months they have just been writing me and not my husband. He also tells me that he cannot sign into the account using his name. I have never communicated with any of them (not even the original debtors that my husband owed). The last payment that my husband made was last month. He pays the agreed amount every month. He has not had any written comms admitting the debt in the last six years.

If the loan was taken out by your husband and they are writing to you (you aren't on the account). Then they are in breach of Data Protection Rules (you might need to complain to the ICO in the future). You should lodge a formal complaint and follow the complaints procedure on their website.
Send them a Subject Access Request, they have 30 days to respond, they should provide at least 6 years data, you'll be able to get to the bottom of why they are writing to you. Make sure you get Proof of Postage. They may say you aren't the account holder, so we can't provide the information, that poses the question 'why are they chasing you for the debt?'
