  • NCP - Parking Charge Notice after 3 months???

    Hi All,

    I just received a Parking Charge Notice after 3 months. Date of incident was 8th September 2023 and the notice was sent on 11th December 2023, which is more than 3 months.

    I wanted to know if anyone could help me on what I can do in this situation or how to appeal, as I was told there was specific legislation stating they have to notify me within 14 days.

    You are correct.
    There is specific legislation dealing with parking on private land (Protection of Freedoms Act 2012 [PoFA 2012] schedule 4)

    If you post up the PCN we can have a look at it for you.
    First remove all identifying details but leave in all dates and times

    Is the car registered in your name?

    Also at no time identify the driver (even on LB as parking companies are known to monitor these sites)

      Please find the PCN attached. I will not say anything till I get your heads up. Yes, the car is registered in my name.

        draft letter for you to use;

        Dear Sirs
        I have just received your Notice to Keeper xxxxx for vehicle VRM xxxx

        You have failed to comply with the requirements of Schedule 4 of The Protection Of Freedoms Act 2012 namely, but not limited to, failing to deliver the notice within the relevant period of 14 days as prescribed by section 9 (4) of the Act. You cannot, therefore, transfer liability for the alleged charge from the driver at the time to me, the keeper.

        There is no legal requirement to name the driver at the time and I will not be doing so.

        Any further communication with me on this matter, apart from confirmation of no further action and my details being removed from your records, will be considered vexatious and harassment. This includes communication from any Debt Collection companies you care to instruct.
