  • HSBC sold the 2nd charge over my property.

    HSBC sold my 2nd charge over property to Cabot Financial, this was for a secured business overdraft taken out March 2008, but our company went under in 2011. The court instructed a payment plan which we are still paying (without a missed payment) but Cabot is now asking us to increase our payments. My question is...................

    The charge on the property title deeds at land registry still states HSBC as the proprietor of the charge. Because this was sold onto Cabot can we apply to have it removed as it not in Cabots name?

    Sorry, but the answer almost certainly is "No". Your application would almost certainly make its way to Cabot - and you might want to consider how Cabot will react and whether this will make things worse for you.
