  • Notice of Intended Prosecution

    Hi,
Have received a NIP in the post from Devon & Cornwall Police.
re : Driving without Due Care

The notice does not have any reference numbers on it? Is this normal. It also only gives the registration number of the car and the road name.
It does not give the make or model of the car, nor does it give an actual location on the road, nor does it actually say what the crime was, apart from Driving without Due Care.

Is this notice legal if it is missing what appears to be very important information?

    Thanks,

Hi Ronniel - sorry for late reply. You are just being informed at this stage as far as I am aware. What does the NIP say about the alleged offence? I don't usually get involved at this early stage so have no expert knowledge but I doubt that the info not being there would at all invalidate an NIP. My advice is go and see a solicitor for a free initial consultation.
