  • Stop Orders and Stop Notices

    The Judge has kicked back our draft stop notice, he/she said we need an N244 application completed and a draft supplied, what is a draft exactley> ?? define draft? Also the charging order must relate to securities and that the email relates to property not securities? define securities here? So our Stop Orders notice provisions do not apply?

    Is there a specific Stop Order form to use against a charging order? Or Stop Order notice form?

        Hi the claimant is trying to pursue a charging order on a property I do not own and have no beneficial interest in? The owner of the property has tried to apply for a Stop Order to be considered when and if the claimants put the charging order through.

          Did you not read my replies to your previous threads? Stop notices relate to payment of money already held by the court (CPR73.12).

          The owner of the property should object if served with notice of an interim charging order. If the title to the property is registered in that person's name and not yours, the likelihood of the court making even an interim charging order over that property is low.

          You appear to have made a hash of jumping a gun that may not even be fired.

            Ah thank you now I understand, my apologies I am on the autistic spectrum and whilst highly intelligent and brilliant, I do tend to go off half cocked As always I appreciate your direct and forthwright approach here, the legal process it is all sinking in now.
