  • Who should i be taking to court

I have purchased a car from an Auctioneer. The Auctioneers description of the car was that it had a "Gold Service" After the paperwork did not materialize i made enquiries and there is no record of such service. I know it seems quite petty but the service would normally cost £5k and without it the value of the car is greatly reduced. There has been some back and forth emails with no resolution. My question is who should i be taking to court ? The auction house or the guy who sold the car through the auction house ?

The person or company that makes the misrepresentation is the guilty party. In your case it was the Auctioneer that made the misrepresentation. They should have checked all details about the car before advertising it.
