    Hj everyone
    I bought a car ,a week later I got a letter and questionnaire from moneybarn stating the person I bought from still owed money the car wasn't hers to sell ,either I hand it back to moneybarn or fill the questionnaire in saying with proof what happened, basically did I buy it knowing about the debt! Obviously I didn't
    The seller has since admitted she did sell it but use the money to settle the debt ,where do I stand ??

    where is the car currently parked is in on your private property or on public road?

    if you genuinely were not aware of the debt on the car before the sale then you should be protected under s.27 of the hire purchase act 1964. That act protects innocent purchasers who purchase a vehicle on finance.

    Do you mind uploading the questionnaire they’ve sent you? That seems to be a new process for Moneybarn so I’m curious what the questions are. You are not however obliged to complete the form. All you. Need to do is write a letter and say you were unaware at the time of sale that the car was subject to a hire purchase agreement but you are protected under s27 of the Hire Purchase Act 1964.

    I would not under circumstances advise that you ignore moneybarn as they do have a habit of taking back the vehicle which is why I asked where the vehicle was parked.

      Hi yes the car is locked in my garage
      I have filled the form out but I cant show you because it has all the names and addresses on it now
      Good to know I have some protection but what will happen now if there really is money owed do I now owe that money ,did I buy the debt ??

        No you didn't buy the debt that would be impossible without some contractual paperwork and I'm sure MB wouldn't just sell the debt to you as well as their asset, that would be silly. The debt continues to sit with the debtor.

        As you have filled in the questionnaire you now have to realise they may use that against you if they feel they have grounds to take the car back, which may include reporting the car as stolen.

        A case of wait and see now.

            So all sorted the seller thought they had settled up but still owed a few hundred quid ,she had been on to them this morning paid the rest I've had a letter saying I'm the legal owner they have no more interest in the car and if will be removed from the hpi red flag
            still it's a bit much to threaten people the way they do before going after the actual debter
            still good result and thankfully it's over

              Thanks for coming back, that's a good result and make sure to keep that letter safe (suggest you put it in with your MOT/service documents) just in case something odd happens in the future.

              I would suggest next time, that you don't fill out any required questionnaires unless you are legally required to do so. You should only supply the necessary information as next time you may not be so lucky with another creditor if you get into this situation again - or at least come back here first before doing anything
