  • Mis sold mortgage

    Looking for information/advice/help over a Mis-sold mortgage, time has lapsed to claim under this but we have all our mortgage file and information showing that we should never have been sold this as we could never pay it off. One solicitor has said they could help for a fee of £50,000+ which we cannot afford. Others on a no win no fee say it’s too complicated, just to much work.
    This broker acted for his own benefit not ours, I personally think what he did was criminal.
    I have tried to sort this for years to no avail. I’m at breaking point. Any help appreciated. Thank you

    You say that time to make a claim has lapsed.

    Limitation periods are there for good reasons , the principal one being finality. No matter how good your claim would have been, if you are out of time that's it.

    Yes, I know that there can be exceptions, but they are for exceptional circumstances. You say that you have been trying to sort this for years, so the circumstances giving rise to a claim do not appear to have been unknown to you.

      Thank you. We have only recently come across paperwork from the brokers office from an ex partner to say we should never have been sold this. Would there be a claim for professional negligence against the broker or his company?
      can you offer any advise on what can be done please?

        Possibly, but you will face the same limitation problems.

        Based on what you have discovered, have you asked the broker how they propose to compensate you?

          He refuses to answer my calls, post is returned. When I ring from another phone he laughs and puts the phone down. We contacted the financial ombudsman who got the same response. This was before we had all the mortgage file, now the FO say the original decision is final and they cannot help us!
