Hi can someone help me with a situation in regards to Bank Smart. they are taking me to court for non payment of commission on a claim. I paid the invoice for the work they did but they then sent a follow up invoice wanting £1.8k of my £3.1 payment. they have harassed me since 2019 , constantly sending invoiced etc. I have PTSD and this has added to my nightmare. Do i have any case against these

Hi and welcome to the forum.

Bank Smart are well known to us so I have tagged EXC who is very knowledgeable on this company.
If you would like a one-to-one expert consultation with me on your employment issue than I can be contacted by emailing admin@legalbeaglesgroup.com

I do not provide advice by PM although I may on occasion ask you to send me documents this way but any related advice will be provided back on your thread.

I do my best to provide good practical advice, however I do so without liability.
If you have any doubts then do please seek professional legal advice.

      Hiya

Don't worry, I'm sure we can help you with this.

I'm assuming they've sent you a letter before claim threatening legal action rather than an actual court claim? In my experience they rarely issue actual claims because they know they would probably lose.

Do you know what the follow up invoice is for (commission, breach of contract, cancellation etc)?

In order to help can you post up a timeline of events please. Also it would be really helpful to see the invoices (paid and allegedly unpaid), letter before claim plus any other relevant correspondence. You can email them to me nick@legalbeaglesgroup.com

        Hi Nick
So glad to get your replay and your offer of help
Bank Smart have put a claim in to the courts which i need to respond to this week.
This situation has gone on for 4 years with them wanting money, forcing me to sign claim forms with the threat of legal action.
As i say i suffer with mental health and have told them constantly with no effect at all, they just carried on ringing, emailing and writing.
I will scan some emails etc for you later today
        Thank you again Nick

Ok and no probs, look forwards to seeing what you send.

In that case we'll need to draft a defence ASAP but I'll no doubt have a lot of questions before we can do that.
