    Hi,
    My flat was rained upon from flat above, this leaseholder wont pay for the damages they say as it was an unforseen accident and they are not liable to pay

    Do you know how this happened? You may have grounds for legal action, but have given very little information.

    Do you have insurance?

      We had 2 similar situations at the block where we have a second home. Unless you can prove negligence my understanding is that you have no legal claim. The leaseholers paid out of decency.
      I think your best hope is for them to make a contribution, negogiate.
      When we were shopping for insurance they all excluded damage by water ingress. Obviously a common problem.
