  • Original housing developer- legal interest?

    Looking for advice:

    House deeds say restrictive covenants have a perpetuity period of 45 years or until the the developer no longer has a legal interest in the estate. What does the latter mean? I have tried to contact the developer to request permission to build a conservatory as per deeds but noone seems interested. I know i could build and seek indemnity etc but what i want to know is what does the term ‘legal interest in the estate’ actually mean?

    Put simply, the question is whether the developer continues to own any part of the estate, e.g. estate roads, common areas.

      Thank you, any idea how i would find this out since the developer are being so hard to get in contact with?

        Land Registry. There may be a lot of individual bits of land whose titles you will need to check.

        But before doing that, check whether the developer is still in existence. Go to Companies House website, and search (a) by company name and (b) by the company number as there may have been a change of company name.

          Thank you- company is still in existence but has since been bought out by a larger company and so is operating under a different name.
